Terms of Service

Last updated: 4 September 2026 · Effective: 4 September 2026

In short. You may use ConverseKit to run a chat widget on websites you control. You are responsible for what your bot says and for the personal data it collects from your visitors. AI models make things up — check anything that matters before relying on it, and never use the widget for medical, legal, financial or safety-critical advice. The service is provided as is, and our liability is capped. This summary is not the agreement; the sections below are.

1. This agreement

These Terms are between you (or the organisation you represent, "you") and Mukerem Shifa, operating ConverseKit ("we", "us"). By creating an account, installing the widget, or using the service, you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.

Our Privacy Policy and Sub-processors list form part of these Terms.

2. The service

ConverseKit provides a hosted AI chat widget that you embed on your website using a script tag. It answers visitors' questions using content you supply, and can collect contact details from those conversations. We provide the software, hosting, and routing to AI providers; you provide the content, the configuration, and the website it runs on.

3. Accounts

  • You must provide accurate registration details and keep them current.
  • You are responsible for all activity under your account, including keeping your credentials and any API keys you supply secure.
  • You must be at least 18 and legally able to enter into contracts.
  • Notify us promptly of any unauthorised use.

4. Acceptable use

You must not use ConverseKit to:

  • Break the law, infringe anyone's rights, or help anyone else do either.
  • Deploy the widget on a website you do not own or have permission to modify.
  • Impersonate a person or organisation, or configure a bot to deny being an AI system when a visitor sincerely asks.
  • Provide medical, legal, financial, psychiatric, or other regulated professional advice, or anything where a wrong answer could cause physical, financial, or legal harm — including emergency, crisis, or safety-critical guidance.
  • Upload as knowledge, or collect through the widget, special category data under GDPR Article 9 (health, biometrics, race, religion, sexual orientation, political opinions), payment card numbers, government identification numbers, or credentials.
  • Send spam, run bulk unsolicited outreach, or harvest contact details deceptively.
  • Attempt to breach or probe the service's security, circumvent rate limits or the origin lock, reverse engineer the service, or access another customer's data.
  • Resell, sublicense, or offer the service to third parties as your own product without our written agreement.
  • Generate content that is harassing, defamatory, or sexually exploitative of minors.

We may suspend or terminate accounts that breach this section. For serious breaches — particularly anything involving illegal content or risk to others — we may act immediately and without notice.

5. AI output

AI models generate text that can be wrong, misleading, or entirely fabricated, including about your own business. This is a known and unsolved property of the technology, not a defect we can fix or a bug you should report as one. It happens even when the bot has correct source material available.

You are solely responsible for what your bot says to your visitors. Specifically:

  • You must review your bot's behaviour before deploying it and monitor it afterwards. Transcripts are available in your dashboard for this purpose.
  • You must not present AI output as professional advice or as verified fact.
  • You are responsible for any commitment your bot appears to make on your behalf — a price, a promise, a guarantee, an availability claim. We are not party to it.
  • Where the law requires you to disclose that a visitor is talking to an AI system, doing so is your responsibility.

We make no warranty that output will be accurate, complete, current, or suitable for any purpose.

6. Your data obligations

When your widget collects personal data from your visitors, you are the data controller and we are your processor. That allocation is not a formality — it means the following are yours to do:

  • Have a lawful basis for collecting your visitors' data, and a privacy notice on your own website that discloses the chat widget, what it collects, and that messages are sent to an AI provider.
  • Respond to your visitors' data subject requests. We provide per-conversation erasure so you can act on one without affecting anyone else.
  • Ensure you have the rights to any content you upload as knowledge for your bot.
  • Choose an AI provider appropriate to your obligations, including any restriction on where data may be processed.

We process visitor personal data only to provide the service and on your documented instructions. We will assist you with data subject requests and security matters as far as is reasonable. If you require a signed Data Processing Agreement, contact us.

On consent prompts. The lead capture feature can instruct the bot to ask a visitor's agreement before recording contact details, and we record that it was instructed to ask. That record is not evidence that a visitor consented, and you must not rely on it as a lawful basis. If you need demonstrable consent, obtain it through a mechanism that produces evidence.

7. Third-party providers

The service routes your visitors' messages to an AI provider you select. Those providers are independent third parties operating under their own terms, and their availability, pricing, model behaviour, and data practices are outside our control. A provider may change or discontinue a model at any time.

If you supply your own API key for a provider, your relationship with that provider is yours, including its costs and its terms. The current list is at Sub-processors.

8. Fees

Where a plan carries a fee, it is as described at the time you subscribe. Fees are billed in advance, are non-refundable except where the law requires otherwise, and are exclusive of taxes, which you are responsible for. We may change pricing with at least 30 days' notice before it applies to your next billing period.

Plans carry usage limits. If you exceed them we may rate limit or suspend service until the next period or until you upgrade. Non-payment may result in suspension and, after a reasonable period, termination and deletion of your data.

9. Intellectual property

Ours. ConverseKit — the software, the widget, the dashboard, the documentation, the name and the marks — remains ours. The source is published for reading under a proprietary licence; publication grants no right to use, copy, host, or create derivative works from it. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the hosted service while your account is in good standing, and nothing more.

Yours. Your content — your knowledge base, your configuration, your transcripts, your leads — remains yours. You grant us a licence to host, process and transmit it solely to provide the service. We do not use your content, or your visitors' conversations, to train AI models.

Feedback. If you send us suggestions, we may use them without obligation or compensation.

10. Availability

We aim to keep the service available but do not commit to an uptime figure and offer no service level agreement. We may perform maintenance, and we may modify or discontinue features. For changes that materially reduce core functionality, we will give account holders reasonable notice where we can.

The service depends on third parties — hosting, database, and AI providers. An outage at any of them can interrupt it, and we are not liable for those interruptions.

11. Disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

We do not warrant that the service will meet your requirements, be error free, or that AI output will be accurate or appropriate.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits rights that consumer law gives you and does not permit us to exclude.

12. Limitation of liability

To the fullest extent permitted by law:

  • Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
  • Our total aggregate liability arising out of or relating to these Terms or the service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100.
  • This applies regardless of the theory of liability and even if we were advised of the possibility of the damages.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law.

13. Indemnity

You will indemnify and hold us harmless from claims, damages and reasonable costs arising from your use of the service, your content, your bot's output to your visitors, your breach of these Terms, or your breach of data protection law in respect of your visitors' personal data.

14. Termination

You may stop using the service and close your account at any time. We may suspend or terminate your account for breach of these Terms, non-payment, or where required by law — with notice where practicable, and immediately for serious breaches.

On termination your right to use the service ends. Export anything you need first: after termination we delete your data within 30 days, except where we must retain it by law. Deleting a bot immediately deletes everything it recorded, including transcripts and leads.

Sections 9, 11, 12, 13 and 16 survive termination.

15. Changes to these Terms

We may update these Terms. We will change the date above, and for material changes we will notify account holders by email at least 30 days before they take effect. Continuing to use the service after that means you accept the new Terms; if you do not, close your account.

16. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction, without regard to conflict of law rules. If you are a consumer, this does not deprive you of the protection of mandatory laws of your country of residence, or of the right to bring proceedings there.

Before filing anything, please contact us — most disputes can be resolved by email.

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, with the Privacy Policy and Sub-processors list, are the entire agreement between us on this subject. You may not assign them without our consent; we may assign them in connection with a merger or sale of the business.
